These Terms of Service apply to all contracts for use of the
Software-as-a-Service platform Insero between Insero, 120 The Strand, Gzira, GZR 1027, Malta
("Provider") and users ("Customers").
Customer terms that deviate apply only if the Provider has expressly agreed to them.
Section 2 Service description
Insero is web-based software for creating, reviewing, and publishing eBay listings
based on product photos, user input, and connected eBay accounts.
The Customer reviews and confirms content before go-live.
After approval, Insero may publish listings via the eBay API.
Insero is not an official service of eBay Inc. and has no economic affiliation with eBay Inc.
Section 3 Account, registration, and access
Use requires an Insero account. The Customer must provide a valid email address and
protect access credentials. Credentials must not be shared with unauthorized third parties.
The Customer is responsible for keeping their information accurate and up to date.
Section 4 eBay account and approval
Go-live requires the Customer's own eBay seller account. The Customer connects this
account through eBay's OAuth process. Insero uses the connection only for
functions required for the listing workflow.
AI-generated content is a suggestion. The Customer must review title, description, condition, included items,
price, category, legal statements, and other listing data before publication.
Section 5 Plans, credits, and payment
The free plan includes 10 listings for testing.
Paid plans are billed monthly and paid through Stripe.
Starter includes 50 listings per month, Pro 150 listings per month, and Studio 500 listings per month.
A listing is counted when a listing is submitted to the listing workflow and/or published after approval.
Unused monthly credits may expire unless otherwise stated in the respective plan.
Section 6 Term, upgrade, and cancellation
Paid plans run monthly and renew automatically unless canceled.
Upgrades can be made through the account or checkout flow.
Cancellation is possible through the account area or by email to kontakt@insero.pro.
The right to extraordinary termination for good cause remains unaffected.
Section 7 Right of withdrawal for consumers
Consumers generally have a statutory right of withdrawal. The withdrawal period is 14 days
from contract conclusion. To exercise the right of withdrawal, the Customer must clearly inform the Provider by email at
kontakt@insero.pro.
For digital services, the right of withdrawal may expire early if the Customer has expressly
agreed that performance begins before the withdrawal period ends and confirmed
that they thereby lose their right of withdrawal.
Section 8 Customer obligations
The Customer is responsible for the legality, accuracy, and completeness of their content.
The Customer must not upload or publish illegal, misleading, trademark-infringing, or copyright-infringing content.
The Customer must ensure offered goods are permitted on eBay and comply with eBay rules.
The Customer must correctly review and reflect visible defects, missing accessories, and uncertainties in the listing.
Section 9 Availability and changes
The Provider strives for stable operation. However, uninterrupted availability cannot
be guaranteed. Maintenance, security updates, third-party outages, eBay API changes,
AI provider failures, or force majeure may affect use.
The Provider may develop, adjust, or replace features as long as the contractual purpose
is not materially impaired.
Section 10 AI results and responsibility
AI output may be incomplete or incorrect. Insero supports the listing process but does not
replace Customer review. The Customer decides whether and with what content a listing
is published.
Section 11 Liability
The Provider is fully liable for intent, gross negligence, and injury to life, body, or health.
For simple negligence, the Provider is liable only for breach of essential contractual obligations and limited to typically foreseeable damage.
No liability exists for incorrect eBay details, incorrect user approvals, suspended eBay accounts, violations of eBay rules, or unreviewed AI suggestions, insofar as the Provider is not responsible for the damage.
Section 12 Privacy
Information on processing personal data is in the
Privacy Policy.
Section 13 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If the Customer is a merchant, the place of jurisdiction is Berlin.
If individual provisions are invalid, the validity of the remaining provisions is unaffected.
